In a recent decision, the Hon’ble High Court of Madras, has ruled that Disabled candidates, who are entitled to 3% reservation in jobs, cannot seek extension of the benefit to promotions as well. While the Court dismissed a writ petition seeking reservation of 3% of vacancies in promotions for disabled persons, the court observed that even under the provisions of the Persons with Disabilities (equal opportunities, protection or rights and full participation) Act, 1995, reservation can be made only after identification of posts. Those provisions are contemplated only for initial appointment and not for promotions.

Three per cent quota in Government Service for the Disabled is only for initial appointments not for Promotions - Madras High Court
Three per cent quota in government service for the disabled is only for initial appointments, and the government cannot be directed to extend it for promotions, ruled the Madras High Court on Monday.
Dismissing a petition seeking a direction to the government to reserve three per cent for promotions to physically handicapped persons, Justice K. Chandru said: “The provisions are contemplated only for initial appointments and not for promotions. The petitioner has not made out any case to seek a direction to provide for reservation for the disabled persons in the matter of promotions in respect of State services.”

Subject : Special Recruitment Drive for filling up backlog reserved vacancies for Persons with Disabilities.
The undersigned is directed to refer to this Department's OM of even number dated 9 th April, 2012 (copy enclosed) whereby all the Ministries/Departments were requested to send the final report about the outcome of the Special Recruitment Drive by 30.4.2012. As already informed the Cabinet has to be apprised about the final outcome of the Drive.
2. The Ministries/Departments are again requested to send the final report of the Special Recruitment Drive to this Department urgently and latest by 21 st May, 2012 so that the Cabinet be apprised about the outcome at the earliest.
